Distributo exists to empower your business by equipping the sales force with smart capabilities and tracking your business on the go. Distributo does this by managing your sales, orders, inventory, invoicing, quotations, credit and delivery schedules. To us at BlueSapling security and privacy of your data is of paramount importance. The trust between you, the user, and BlueSapling forms the bedrock of our relationship. A fundamental part of earning that trust means being clear about how we use your information and protect your human right to privacy.

1. Definitions

   This privacy policy describes how BlueSapling Technologies Pvt. Ltd. ('BlueSapling', 'Company', 'we', 'us' or 'our') collects, protects, and uses the personally identifiable information ('Personal Information', 'Personal Data') you ('Customer', 'you' or 'your') may provide through our Distributo website or Distributo mobile application together called as the "Platform" or any of its products or services (collectively, 'Website' or 'Services'). It also describes the choices available to you regarding our use of your Personal Information and how you can access and update this information. This Policy does not apply to the practices of third-party companies that we do not own or control, or to individuals that we do not employ or manage.

   Undefined terms in this Privacy Policy have the same definition as in our Software as a Service(SaaS) Agreement

2. Information collection and use?
   1. Information needed to use our Distributo Platform

      We collect personal information about you when you first create your account in our Distributo platform. Without it, we may not be able to provide you with all services requested. This information includes:

      • Contact Information, Account, Profile Information. Such as your first name, last name, phone number, email address.
      • Identity Verification. Such as your business GSTIN and other verification information.
   2. Information you choose to give us

      You can choose to provide us with additional personal information. This information may include:

      • Geo-location Information. Such as precise or approximate location determined from your IP address or mobile device’s GPS depending on your device settings. We may also collect this information when you’re not using the app if you enable this through your settings or device permissions.
      • Other Information. Such as when you fill in a form, add information to your account, respond to surveys, participate in promotions, communicate with our customer care team and other Members, or share your experience with us.
   3. Information Automatically Collected by Using the Distributo Platform.

      When you use the Distributo Platform, we automatically collect personal information. This information may include:

      • Usage Information. Such as the pages or content you view, and other actions on the Distributo Platform.
      • Log Data and Device Information. Such as details about how you’ve used the Distributo Platform (including if you clicked on links to third-party applications), IP address, access dates and times, hardware and software information, device information, device event information, unique identifiers, crash data, cookie data, and the pages you’ve viewed or engaged with before or after using the Distributo Platform. We may collect some of this information even if you haven’t logged in.
      • Cookies and Similar Technologies as described in our Cookie Policy.
   4. Personal Information We Collect from Third Parties.

      We collect personal information from other sources such as:

      • Referrals If you are invited to the Distributo Platform, the person who invited you can submit personal information about you such as your email address or other contact information.
3. What do we do with your information that we collect?
   1. Provide, Improve, and Develop the Distributo Platform.

      We use personal information to:

      • provide customer service,
      • perform analytics, debug and conduct research,
      • send you messages, updates, security alerts, and account notifications.
   2. Create and Maintain a Trusted and Safer Environment.

      We use personal information to:

      • detect and prevent fraud, spam, abuse, security and safety incidents, and other harmful activity,
      • conduct security investigations,
      • verify or authenticate information provided by you,
      • comply with law, respond to legal requests, prevent harm and protect our rights,
      • enforce our Terms and other policies.
   3. Provide, Personalize, Measure, and Improve our Advertising and Marketing.

      We may use personal information to:

      • send you promotional messages, marketing, advertising,
      • personalize, measure, and improve our advertising,
      • administer referral programs, rewards, surveys, sweepstakes, contests, or other promotional activities or events sponsored or managed by BlueSapling,
      • analyze characteristics and preferences to send you promotional messages, marketing, advertising and other information that we think might be of interest to you, and
      • invite you to events and relevant opportunities.
4. Whether we disclose the data to third parties

   Depending on the requested Services or as necessary to provide any service you have requested, we may share your information with our trusted third parties that work with us, any other affiliates and subsidiaries we rely upon to assist in the operation of the Website and Services available to you. We do not share Personal Information with unaffiliated third parties. These service providers are not authorized to use or disclose your information except as necessary to perform services on our behalf or comply with legal requirements. We may share your Personal Information for these purposes only with third parties whose privacy policies are consistent with ours or who agree to abide by our policies with respect to Personal Information. These third parties are given Personal Information they need only in order to perform their designated functions, and we do not authorize them to use or disclose Personal Information for their own marketing or other purposes.

5. User Rights over their data

   You can exercise any of the rights described in this section consistent with applicable law. Please note that we may ask you to verify your identity and request before taking further action on your request.

   • Managing your information

     You can access and update some of your personal information through your account organization settings. You are responsible for keeping your personal information up to date.

   • Data access and portability

     In some jurisdictions, applicable law may entitle you to request certain copies of your personal information or information about how we handle your personal information, request copies of personal information that you have provided to us in a structured, commonly used, and machine-readable format.

   • Data erasure

     In certain jurisdictions, you can request that your personal information be deleted. Please note that if you request the erasure of your personal information:

     • We may retain your personal information as necessary for our legitimate business interests, such as prevention of money laundering, fraud detection and prevention, and enhancing safety. For example, if we suspend a Distributo Account for fraud or safety reasons, we may retain information from that Distributo Account to prevent that Member from opening a new Distributo Account in the future.
     • We may retain and use your personal information to the extent necessary to comply with our legal obligations. For example, BlueSapling may keep information for tax, legal reporting, and auditing obligations.
     • Information you have shared with others (e.g., Reviews) will continue to be publicly visible on Distributo, even after your Distributo Account is cancelled. However, attribution of such information to you will be removed. Some copies of your information (e.g., log records) will remain in our database, but are disassociated from personal identifiers.
     • Because we take measures to protect data from accidental or malicious loss and destruction, residual copies of your personal information may not be removed from our backup systems for a limited period of time.
6. Privacy of children

   We do not knowingly collect any Personal Information from children under the age of 18. If you are under the age of 18, please do not submit any Personal Information through our Website or Service. We encourage parents and legal guardians to monitor their children's Internet usage and to help enforce this Policy by instructing their children never to provide Personal Information through our Website or Service without their permission. If you have reason to believe that a child under the age of 18 has provided Personal Information to us through our Website or Service, please contact us. You must also be old enough to consent to the processing of your Personal Information in India.

7. Security

   We are continuously implementing and updating administrative, technical, and physical security measures to help protect your information against unauthorized access, loss, destruction, or alteration.

8. Business Transfer

   If BlueSapling undertakes or is involved in any merger, acquisition, reorganization, sale of assets, bankruptcy, or insolvency event, then we may sell, transfer or share some or all of our assets, including your information in connection with such transaction or in contemplation of such transaction (e.g., due diligence). In this event, we will notify you before your personal information is transferred and becomes subject to a different privacy policy.

9. Disclosure

   We will disclose any Personal Information we collect, use or receive if required or permitted by law, such as to comply with a subpoena, or similar legal process, and when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a government request.

   Where appropriate, we may notify Members about legal requests unless: (i) providing notice is prohibited by the legal process itself, by court order we receive, or by applicable law, or (ii) we believe that providing notice would be futile, ineffective, create a risk of injury or bodily harm to an individual or group, or create or increase a risk of fraud upon or harm to BlueSapling, our Users, or expose BlueSapling to a claim of obstruction of justice.

10. Data Breach

    In the event we become aware that the security of the Website has been compromised or users Personal Information has been disclosed to unrelated third parties as a result of external activity, including, but not limited to, security attacks or fraud, we reserve the right to take reasonably appropriate measures, including, but not limited to, investigation and reporting, as well as notification to and cooperation with law enforcement authorities. In the event of a data breach, we will make reasonable efforts to notify affected individuals if we believe that there is a reasonable risk of harm to the user as a result of the breach or if notice is otherwise required by law. When we do, we will post a notice on the Website, send you an email, get in touch with you over the phone, mail you a letter.

11. Changes to privacy policy

    We reserve the right to modify this Privacy Policy at any time in accordance with applicable law. If we do so, we will post the revised Privacy Policy and update the “Last Updated” date at the top. In case of material changes, we will also provide you with notice of the modification by email at least thirty (30) days before the effective date. If you disagree with the revised Privacy Policy, you can cancel your Account. If you do not cancel your Account before the date the revised Privacy Policy becomes effective, your continued access to or use of the Distributo Platform will be subject to the revised Privacy Policy.

12. Acceptance of this policy

    You acknowledge that you have read this Policy and agree to all its terms and conditions. By using the Website or its Services you agree to be bound by this Policy. If you do not agree to abide by the terms of this Policy, you are not authorized to use or access the Website and its Services.
